Article 1 — Organizer
The Vootday contests (hereinafter the "Contest") are organized by Christian Bastide, a sole proprietorship registered in the Swiss Commercial Register under number CHE-188.708.624, with registered office at Rue Jakob 1, 2504 Biel/Bienne, Switzerland (hereinafter the "Organizer"), publisher of the Vootday mobile application (hereinafter the "App").

Article 2 — Purpose, Editions and Annexes
2.1 — The Contest rewards the creative quality of the outfits published by users of the App.
2.2 — Editions. The Contest takes place in successive Editions. Each Edition constitutes a separate contest, governed by these framework rules and by its Annex.
2.3 — Annex. Each Edition is the subject of an Annex, published in the App and at www.vootday.com/contest no later than the day it opens, which sets out:
- The name of the Edition and the month concerned
- The closing date (the "Closing Date") and the date on which the results are announced
- The number of prizes, their amount and the categories
- The eligible countries
- The length of the publication streak required for certification
- Whether the ranking is restricted to Certified Members
In the event of any conflict between the framework rules and an Annex, the Annex prevails for the Edition concerned.
2.4 — No commitment to recurrence. The Organizer is under no obligation as to recurrence, renewal or the continuation of any parameter from one Edition to the next. The prize amount, the categories and the eligible countries may vary from one Edition to the next.
2.5 — All times mentioned are Zurich time (Europe/Zurich time zone).
Article 3 — Entry conditions
Entry is entirely free of charge and no purchase is necessary. No stake, payment or financial consideration is required at any stage.
To enter an Edition, all of the following conditions must be met:
3.1 — Hold an account on the App, created and maintained in accordance with the Terms and Conditions of Use.
3.2 — Hold Certified Member status within the meaning of Article 4.
3.3 — Meet the following eligibility conditions, depending on the nature of the account holder:
a) Individual account holders
- be at least 18 years of age on the Closing Date of the Edition;
- reside in one of the countries listed in the Annex of the Edition;
- have a profile indicating one of the categories defined in Article 6.
b) Legal-entity account holders (brand accounts)
Brand accounts enter under the same conditions as other participants and may be designated Winners. They must:
- correspond to an entity whose registered office is established in one of the countries listed in the Annex;
- be represented by an adult natural person authorized to accept these rules.
3.4 — Have published at least one outfit during the period of the Edition. Only publications posted during the period of the Edition are eligible to be designated Winners.
Persons meeting these conditions are hereinafter referred to as the "Participants".
Article 4 — Certified Member status and overall ranking
4.1 — Nature of the status. Certified Member status is a permanent feature of the App, independent of the Contest. It is not reserved for Participants, does not require any registration for the Contest, and is not created by these rules.
4.2 — Accessibility. It is open to any user of the App, without any condition of age, country or category, provided that they meet the publication conditions described in the App: the publication of at least one outfit per calendar day, for a number of consecutive days indicated in the App and restated in the Annex of each Edition (ten (10) days as of the date of these rules).
Several publications on the same calendar day count as one day only. The streak is assessed on the basis of the date the publication is posted. Any calendar day without a publication breaks the streak, which then restarts from zero; no tolerance, deferral or catch-up is provided for.
4.3 — Definitive nature. The status is definitive. Once acquired, it cannot be revoked on account of subsequent inactivity or an interruption of the streak, subject to Article 9.
4.4 — Changes. The conditions for obtaining the status and its effects are those described in the App and governed by the Terms and Conditions of Use. They may change independently of the Contest. No change has retroactive effect on an ongoing Edition.
4.5 — Possible restriction of the ranking. The Annex of each Edition indicates whether the ranking for the period is restricted to publications by Certified Members. Where this restriction applies, only those publications appear in the ranking and may therefore be designated Winners. In the absence of such a restriction, the ranking is open to all publications.
4.6 — Relationship with the Contest. The Contest is played out on the App's ranking: any publication appearing in the ranking competes, subject to the eligibility conditions of Articles 3, 5, 6 and 7. The Contest creates neither a parallel ranking nor any additional access condition.
Article 5 — Exclusions
The following are excluded:
- persons who are not at least 18 years of age on the Closing Date;
- persons not residing, or entities not established, in one of the countries listed in the Annex;
- users who do not hold Certified Member status;
- the Organizer, members of their immediate family and any person who took part in the design or organization of the Contest;
- any person holding more than one account on the App. Only one identity per person is permitted; holding multiple accounts results in the cancellation of all corresponding entries.
Article 6 — Categories
Each Edition comprises the categories defined by its Annex. The category of a publication is chosen by the Participant at the time it is posted. A publication competes only in its category.
Article 7 — Ranking and designation of the Winners
7.1 — Duel and Vote. Publications are presented to users in duels: two publications are displayed simultaneously and the user selects the one they prefer. This selection constitutes a "Vote".
Duels are composed automatically by the App. The user chooses neither the publications presented to them nor the opponent of a given publication. The same publication may be presented to them several times during an Edition, each selection constituting a separate Vote.
7.2 — Composition of the duels. The selection of the publications in a duel follows a rule of fair exposure: among the recent publications in the same swipe zone and the same category, the App retains those that have been the least exposed so far, taking into account both the number of duels already contested and the age of the publication, and then draws two of them. The pair previously displayed to the user is excluded.
As a result, a publication that has already been seen a lot is offered less frequently, and a recent or little-exposed publication is offered more often. This mechanism is intended to give each publication a comparable chance of being seen; it does not by itself award any points, ranking or prize.
7.3 — Ranking score (Elo). The ranking is based on an Elo-type score, not on the number of Votes received.
Each publication starts with an identical score. At the end of each duel, the score of the selected publication increases and that of the other decreases, to an extent that depends on the score gap between the two publications in the duel: winning against a higher-ranked publication yields more than winning against a lower-ranked publication. The score cannot become negative. The update is immediate with each Vote.
As a result, a publication that has received fewer Votes than another may nevertheless be ranked higher, and vice versa. The ranking reflects the quality of the duels won, not the volume of exposure.
7.4 — Establishment of the ranking. The ranking is calculated continuously, based on the publications that cumulatively:
- are online and approved by moderation;
- were posted during the period of the Edition;
- belong to the swipe zone and category concerned;
- have contested at least one duel;
- where the Annex so provides, originate from a Certified Member.
Publications are ordered by decreasing score. The App displays the top ten; the Winners are, however, determined on the basis of the full ranking.
7.5 — Designation of the Winners. In each category, the publication with the highest score on the Closing Date, among those meeting the conditions of Articles 3, 5, 6 and 7.4, is designated the Winner.
If the highest-ranked publication does not meet the eligibility conditions — in particular as to age or category — it is not retained for the prize, which then goes to the highest-ranked eligible publication. The ranking is not modified as a result: it continues to reflect the scores obtained, regardless of eligibility for the Contest.
The Winner is designated exclusively by the choices expressed by the users of the App. No random draw is involved in the awarding of the prizes.
7.6 — Tie-breaking. In the event of a tie in scores, the following are applied in turn:
- the greater number of duels contested;
- failing that, the earlier posting date.
7.7 — Closing. The ranking retained for the Edition is frozen by the Organizer on the Closing Date, Zurich time. Votes recorded after that moment do not modify the retained ranking.
7.8 — A Participant may win only one prize per Edition.
Article 8 — Prizes
8.1 — The number of prizes, their amount and the categories concerned are set by the Annex of each Edition. They may vary from one Edition to the next.
8.2 — Unless the Annex states otherwise, each prize takes the form of a gift card or voucher for the amount indicated, from a retailer chosen by the Winner, provided that the retailer actually offers gift cards or vouchers and that they can be used in the Winner's country of residence.
8.3 — The Organizer reserves the right to refuse a retailer that would not be compatible with the values of the platform, and in that case to offer an alternative of equivalent value.
8.4 — The prize is strictly personal, non-transferable, cannot be exchanged for cash and cannot give rise to any supplement, refund or consideration in any form whatsoever.
8.5 — If the Winner does not designate a retailer within the period provided for in Article 8.7, the Organizer will provide them with a gift card of equivalent value from a retailer of the Organizer's choosing.
8.6 — Prior verification. Before any prize is delivered, the Organizer verifies the identity, age and country of residence of the Winner or, for a brand account, the existence and registered office of the entity. The Winner undertakes to provide the supporting documents requested (identity document, proof of address or commercial register extract). Any refusal, any impossibility of verification or any discrepancy with the information declared results in forfeiture of the prize.
8.7 — Time limits. Winners are contacted within seven (7) days of the Closing Date, via the App or the email address associated with their account. They have fifteen (15) days to come forward and provide the supporting documents. After this period, the prize is deemed abandoned and the Organizer may, without being obliged to, award it to the next Participant in the ranking.
Article 9 — Fraud and manipulation
9.1 — Any fraud, attempted fraud or breach of these rules results in the immediate exclusion of the Participant and the cancellation of all their entries, without notice or compensation, without prejudice to the measures provided for by the Terms and Conditions of Use, which may include the withdrawal of Certified Member status or the suspension of the account.
9.2 — Any attempt, by a person whether or not participating in the Contest, to distort the course of an Edition or to unduly obtain a prize may give rise to exclusion and, where applicable, to legal proceedings.
9.3 — The following in particular are considered manipulations: the creation or use of multiple accounts, the use of automated accounts or devices, the purchase of Votes, the organization of concerted Vote exchanges, and the circumvention of technical protection measures.
9.4 — Votes excluded from the ranking. Votes exhibiting abnormal characteristics with regard to the usual use of the App — in particular in terms of pace, volume, technical origin or concentration on the same publication — are excluded from the determination of the Winners.
As the score is calculated step by step, the exclusion of such Votes leads the Organizer to recalculate the ranking of the Edition by neutralizing the duels concerned. This recalculation takes place before the announcement of the results and does not affect the user experience of the App.
9.5 — Verifications. The Organizer reserves the right to carry out, directly or indirectly, any useful verification relating to identity, age, place of residence and number of entries, as well as to the regularity of the Votes recorded. An audit of the top five publications in each category is carried out before any public announcement of the results.
9.6 — The Organizer's decisions regarding fraud are reasoned and notified to the Participant concerned. They are taken on the basis of technical evidence retained as proof.
Article 10 — Modification, suspension and liability
10.1 — The Organizer reserves the right to modify, extend, shorten, suspend or cancel an Edition, in particular in the event of force majeure, a major technical malfunction or proven manipulation compromising the integrity of the ranking. The Organizer cannot be held liable as a result.
10.2 — The Organizer cannot be held liable for network malfunctions, Participants' equipment, data loss, or any event beyond their reasonable control that prevented or disrupted an entry.
10.3 — These framework rules may be modified between two Editions. A modification during an Edition occurs only if required by a legal or technical necessity. Any modification is published at www.vootday.com/contest and in the App, and takes effect upon publication.
Article 11 — Taxes
Any taxes, duties and contributions that may be due in respect of the prize are the sole responsibility of the Winner, who is personally responsible for any reporting obligation in their country of residence.
It is up to the Winner to inquire about the regime applicable to them. The Organizer makes no withholding and provides no tax advice.
Article 12 — Personal data
The processing of the personal data of the users of the App is governed by the Privacy Policy, which applies in full to the Contest.
This article sets out only the processing operations specific to the Contest:

Retention periods specific to the Contest: entry data and anti-fraud technical logs are retained for twelve (12) months from the Closing Date, for evidentiary purposes and to handle any disputes. The Winners' identity documents are deleted as soon as the prize has been delivered.
The rights of access, rectification, erasure, restriction, objection and portability are exercised under the conditions provided for by the Privacy Policy. Exercising the right to erasure during an Edition may make it impossible to process the entry.
Article 13 — Use of the Winners' content
By entering, each Participant authorizes the Organizer, in the event of a win, to reproduce and distribute their username and the winning publication for the purposes of announcing the results and communicating about the Contest, on the App, the Organizer's website and their social media accounts.
This authorization is granted free of charge, for a period of twelve (12) months from the announcement of the results, for the countries of the Edition concerned. It confers no right of commercial exploitation of the Winner's image outside this framework.
The Winner may withdraw this authorization at any time by writing to contact@vootday.com; this withdrawal applies to the future and does not affect publications already distributed.
Article 14 — No affiliation with the platforms
This Contest is neither organized, nor sponsored, nor administered by Apple Inc. or Google LLC, which are not associated with it in any way. Any question, comment or complaint relating to the Contest must be addressed exclusively to the Organizer, at contact@vootday.com.
Article 15 — Governing law and disputes
These rules are governed by Swiss law, without prejudice to the mandatory consumer protection provisions applicable in the Participant's country of habitual residence.
Any complaint must be sent to contact@vootday.com within thirty (30) days of the Closing Date. The Organizer undertakes to respond within a reasonable time and to seek an amicable solution before any proceedings.
Article 16 — Acceptance
Entry implies full, complete and unreserved acceptance of these framework rules and of the Annex of the Edition concerned.
The rules can be consulted free of charge in the App and at www.vootday.com/contest, throughout the duration of each Edition and until the prizes have been delivered.
